Man Who Posted Ex-lover Nude Pictures on Social Media Gets 2 Years Jail


A 40-year-old man, Olubunmi Ayan, has been sentenced to two years imprisonment for revenge porn. Revenge porn or revenge pornography is the distribution of sexually explicit images or video of individuals without their permission. The sexually explicit images or video may be made by a partner of an intimate relationship with the knowledge and consent of the subject, or it may be made without his or her knowledge.



Mr Olubunmi postedon Facebook the nude pictures of his former lover, Monica Arare,  in Ekiti State Justice Taiwo Taiwo of the Federal High Court, Ado-Ekiti, Ekiti State, yesterday, also fined the convict N500,000 and ordered the police to arrest anyone who harassed the victim as a result of Ayan’s conviction.

The suit, FHC/AD/17c/2017, filed by the office of the Attorney General of the Federation (AGF), Abubakar Malami (SAN), and Ayan the complainant. Counsel and FIDA member to the AGF, Mrs. Oyewole, told the court that Ayan had threatened to post Arare’s nude pictures on the social media sometimes in 2017, when the lady told him she was no longer interested in the relationship.

According to the counsel, Arare, a single lady, had pleaded with Ayan, who is married and has children, not to carry out his threat. Oyewole said the convict then requested N200,000 as inducement for him to rescind his decision. Ayan, however, posted her nude pictures when she could not give him the money.

Taiwo revealed that he had been lenient in sentencing Ayan as the punishment for his crime attracted a fine of N7 million and three-year jail term, according to the Cyber Crime Act. The judge, however, regretted that the law did not make provisions for compensation for victims. He therefore advised that such provision should be made by the lawmakers in a future exercise in amending the laws.

The prosecution called four(4) witnesses to prove its case against the Defendant.

Meanwhile FIDA Ekiti in a statement released praised the decisions of the Federal High Court stating that

” this is a gender based violence against the victim and totally condemns same. It is a crime against humanity and gross wickedness against womenfolk. It is condemnable and should not be allowed to strive in any civil society.

We commend this judgement and hope it will serve as deterrence to others who are in the habit of abusing and molesting children and girls.

We also call for a review of all laws relating to GBV. It is unfortunate that for this kind of offence the law provides for maximum of three years jail term and an option of fine without looking at making provisions for the adequate compensation of victims of such gory acts.

From all indications, posting of nude picture(s) of whosoever on social media in peculiar circumstances may attract jail sentence by provisions of Cyber Crime Act, 2015.
